Terms of Service and Licence

Draft for review. Grounded in what the software actually does, but not reviewed by a lawyer. Have it reviewed before you take money - particularly the liability and consumer-guarantee sections, which Australian law constrains more tightly than most templates assume.


1. What you are agreeing to

By installing or using Hosia you accept these terms. If you do not accept them, do not install it. "We" and "us" mean Arman Khan trading as Hosia; "you" means the person or organisation using it.

2. Licence

Hosia is a derivative work of Hermes Agent by Nous Research, used under the MIT Licence. That licence is reproduced in full in LICENSE, and the relationship is set out in NOTICE. Hosia is not affiliated with, endorsed by, or supported by Nous Research.

You may install and use Hosia on any machine you control, for personal or commercial work, including for clients.

You may not resell Hosia as a hosted service to third parties, or remove or obscure the attribution required by the MIT Licence.

3. What the software does - read this part

Hosia executes commands on your computer, reads and writes your files, and sends data to an AI provider you choose. It is an automation tool that takes real actions on real systems.

You are responsible for:

A large language model is not deterministic and not reliable. It will sometimes be confidently wrong. Do not use Hosia for anything where a wrong action is unacceptable and unrecoverable, unless you have independently verified the action first.

4. The Wall, and what it is not

Hosia refuses a fixed set of actions in code, before the tool runs: sending to customers, moving money, reading credential files, deploying to production. Configuration and bot files may narrow what is permitted; they cannot widen it. A file attempting to widen it fails to load rather than loading with the restriction dropped.

This is a safety floor, not a guarantee of safety. It is a defence against a model being talked into a specific class of action. It is not a defence against every mistake a model can make, and it does not make the software safe to point at systems you cannot afford to have damaged. It reduces blast radius; it does not remove it.

You must not rely on the Wall as your only control over a production system.

5. Paid subscriptions

A subscription gives you a token that routes requests through our gateway to an AI provider, so you do not have to hold a provider account yourself.

Refunds

Nothing in these terms excludes, restricts or modifies the consumer guarantees under the Australian Consumer Law, which cannot be contracted out of. If the software is faulty, not as described, or does not do what we said it does, you are entitled to a remedy under that law regardless of anything written here.

Beyond those rights, and because a subscription's cost to us is incurred as you use it:

6. Availability

The gateway is offered as-is, with no uptime commitment. It is operated by one person. If it is down, the software still works with your own API key - that path does not depend on us at all, which is deliberate.

7. Liability

To the extent permitted by law, and subject to section 5's consumer guarantees:

Hosia is free software for users who bring their own key. If you are not paying us, our liability to you is limited to the fullest extent the law allows.

8. Ending it

You may stop using Hosia at any time. We may suspend or end a paid account that is being used unlawfully, to attack others, or in a way that endangers the service. Where we do, we refund the unused portion of the current period.

9. Governing law

These terms are governed by the law of Victoria, Australia. Disputes go to the courts of Victoria, subject to any right you have to bring a matter before a consumer tribunal.
